Businessman Pleads Guilty in Fraud Scheme

PITTSBURGH—A Pittsburgh-area businessman has pleaded guilty in federal court to charges of conspiracy, bribery of agent of an organization receiving federal funds, and mail fraud, United States Attorney David J. Hickton announced today. Arthur J. Bedway, Jr., 63, pleaded guilty to three counts before United States District Judge Cathy Bissoon. In connection with the guilty plea, the court was advised that Bedway owned Victory Security. In order to obtain a contract with the city of Pittsburgh to install radios and mobile data terminals (MDTs) in city police cars, Bedway created Alpha Outfitters, which he falsely represented to the city as a Women's Business Enterprise (WBE). He conspired with a city employee, Christine Ann Kebr, and others to obtain the MDT contract for Alpha Outfitters. Bedway paid Kebr for her assistance in obtaining the MDT contract. Judge Bissoon scheduled sentencing for November 20, 2013 at 10:00 a.m. The law provides for a total sentence of 35 years in prison, a fine of $750,000, or both. Under the Federal Sentencing Guidelines, the actual sentence imposed is based upon the seriousness of the offenses and the criminal history, if any, of the defendant. Pending sentencing, the court continued bond. Assistant United States Attorneys Robert S. Cessar and Lee J. Karl are prosecuting this case on behalf of the government. The Federal Bureau of Investigation and Internal Revenue Service-Criminal Investigation conducted the investigation that led to the prosecution of Bedway.

This is the END! Last stop, Winnipeg!Mark Scheifele - Barrie ColtsScheifele had a terrific season, undoubtedly his last in the OHL. I was actually reasonably critical of his play in 2011/2012, after I felt like he was not consistently noticeable enough for a top 10 pick. At the time (August 2012), I said, "If he does return to Barrie, I'm hoping he can really dominate and come back like a man on a mission. In order to do that, he's going to have to take that next step in using his size aggressively on offense, taking over the boards and being a load to stop on the way to the net." Well, that's EXACTLY what he did this year. Scheifele was an absolute load to handle for opposing defenses in 2012/2013. With the puck, he was aggressive in looking to the middle of the ice and consistently drove to the net looking to create. Without the puck, he did the same thing, trying to open up space for linemates, in addition to looking for scoring opportunities in close to the crease. He was more aggressive physically without the puck and transformed himself into a very difficult player to win battles in the corners against. Offensively, he became a multi-faceted player, a guy who could beat you off the rush, but also below the hash-marks. Scheifele also had significantly more confidence in his shot this year, looking to use it whenever he could. His release looked much improved and he had no trouble burying his share of chances (next to OHL leading goal scorer Reid Boucher, he had the best goals per game average in the league). On top of the improvements offensively, Scheifele also looked stronger defensively as he brought more intensity to his backchecking assignments. To sum it up, the Jets made the right choice sending him back for another year. In 2013/2014, Scheifele can play in the AHL or the NHL. I'd be surprised if he doesn't make the Jets at this point, where I suspect he'll have a pretty decent first season. IMO a 20/20 year is well within his grasp.   Scott Kosmachuk - Guelph StormAnother solid year for Kosmachuk, playing his brand of in your face offensive hockey. He's definitely what you would refer to as a "crease crasher." He's constantly buzzing without the puck and is relentless in puck pursuit. His play with the puck is an underrated component of his game, as he has enough skill to take defenders one on one and loves to try and get past them on the outside. I think he'll still need to add another gear to his stride in order to be more effective at this, but the effort level is there. Even though the goal numbers didn't improve considerably, I did think his shot looked better this year. He had more power behind it and looked more confident doing it. In a lot of ways, Kosmachuk plays the game like his coach in Guelph, Scott Walker. He's certainly the perfect guy to be teaching him the ropes. Next year, Kosmachuk will return to Guelph and should have a big year. After leading the Storm in scoring this year, I expect that to grow even more, perhaps to the tune of a 40 goal, 80 point season in 2013/2014.  Austen Brassard - Belleville BullsTruthfully, I was a little surprised that Brassard got a contract offer from the Jets after he posted the worst offensive numbers since his 16 year old season. Now numbers don't tell the whole story, but they do tell some of it. This year, Brassard did play the most aggressively that he has as an OHL player. He was a consistent physical threat and grew into a quality player without the puck, at both ends of the ice. But he wasn't able to get a whole lot done with the puck this year. While he was aggressive in trying to drive to the net, his puck skills nor his acceleration have ever really ever improved to the point where he's a consistent scoring threat from the outside. His shot is also not terrific and he needs time and space to get it off. With his size, he should be scoring a lot more goals in close to the net, but that wasn't the case this year as he often found himself out of scoring position. After last year's breakthrough offensively, I had high expectations for him but was left underwhelmed. Next year he'll be in the AHL where I imagine he'll start on a checking line. At this point, it's hard to imagine him putting up large offensive numbers and I think he'll take some time adjusting to the speed of the pro game. A 10-10 first year would be a realistic expectation.   Jimmy Lodge - Saginaw SpiritI thought Lodge was a steal and a half where the Jets picked him up. He needs to fill out his frame, but he oozes offensive potential (as I've mentioned in a previous article, Lodge finished the season with 45 points (18 goals, 27 assists) in his final 31 games). He's a great skater and can be aggressive coming down the wing, whether it be looking to go hard to the net, or finding space for his above average shot. He's also got good offensive instincts and seems to find himself in good position to make offensive plays. He'll need to continue to round out his game by working harder in his own end and in the corners. And he'll need to get stronger so he's not pushed off the puck as easy, and to make him more effective along the wall. But the potential is very high. Next year he'll continue to play on Saginaw's first line. This could include Eric Locke (who he's built up great chemistry with) if he's returned by Buffalo for his overage year. I think he'll have an excellent season and can crack the 70 point mark.

Low and behold, during her performance of song "Bow Down", Jay Z appeared to preform his new tune off "Magna Carta Holy Grail" called "Tom Ford". Beyoncé in her black and gold jersey dress outfit and animal hat, was grinding through "Bow Down" with her backup dancers when she stopped mid song. The man that makes her Mrs. Carter appeared from the left and took over the stage. At first Beyoncé strutted away from Jay as he came toward her. Bey eventually plopped down on the side of the stage to sit and watch her man do his thang. She grooved in her seat while chilling on the side as he rapped his way through the song, which, by the way features Beyoncé as her hip hop alter ego "Third Ward Trill" on backup vocals. T.W.T. sang along to the "Tom Ford" song and Bey finally got up to end the song next to Jay where they danced together. The couple snuck a hug and a kiss before Jay ran off stage and Beyoncé continued performing her song "Bow Down". Learned Intermediary Bars Consumer Protection Claims in Pennsylvania

            We talk a lot about the learned intermediary doctrine on this blog.  Rightfully so.  It is a powerful tool for drug and medical device defendants.  In a nutshell, the learned intermediary doctrine says that pharmaceutical companies’ duty is to warn doctors, not patients, about the risks of prescription drugs.  It is a recognition of the essential role the physician plays when it comes to prescription drugs and devices.  And, while the doctrine inures to the benefit of defendants, it is not an affirmative defense.  That is, the plaintiff still bears the burden to prove proximate causation.  The plaintiff must prove that the doctor would have made a different prescribing decision if he had the information that plaintiff claims he should have had.  And, as an essential element of plaintiff’s case, plaintiff must plead sufficient facts to support his claim that his physician would have acted differently.                That’s where plaintiff in today’s case ran into some trouble.  Plaintiff brought a purported class action seeking a refund of what he spent on Avandia alleging that defendant violated Pennsylvania’s Unfair Trade Practices and Consumer Protection Law (“UTPCPL”).  In re Avandia Marketing, Sales and Products Liab. Litig., MDL 1871 (Morgan v. Smithkline Beecham Corp.), 2013 U.S. Dist. LEXIS 96774 (E.D. Pa. Jul. 10, 2013).  There was no personal injury alleged.  Rather, the crux of plaintiff’s claim is that even though Avandia is effective in reducing blood-sugar, because it allegedly carries an increased risk for heart-related disease, the drug “has no health benefit.”  Id. at *2-3.  The court did not have to get into the substance of the claim, however, because plaintiff failed to allege any facts that would get him around the learned intermediary doctrine.  The court also refused to recognize a direct-to-consumer exception to the learned intermediary doctrine.  Once again, New Jersey remains a party of one on that issue.            It is worth noting that this was plaintiff’s second attempt to state his claim.  The original complaint was dismissed because plaintiff failed to allege, among other things, “what materials or information his physician relied upon.”  Id. at *1.  Plaintiff tried to fix that deficiency by alleging that his physician reviewed defendant’s “marketing and statements.”  Id. at *2.  But that wasn’t enough to cure the fatal inadequacies of plaintiff’s pleading.  Fatal because this time, the court dismissed the case with prejudice.              The court starts off by acknowledging that the learned intermediary doctrine applies to consumer protection claims – and in Pennsylvania almost always bars them.  Pennsylvania’s consumer protection statute requires reliance and under the learned intermediary doctrine it is the prescribing physician upon whom plaintiff relies – not the manufacturer:  Under the learned intermediary doctrine, the drug manufacturer owes a duty of disclosure to the prescribing physician, but it is then the duty of the prescribing physician to communicate any risks or other information about the drug to the patient.  As courts have held, the existence of the learned intermediary doctrine in Pennsylvania makes it difficult, if not impossible, for plaintiffs to successfully bring a UTPCPL claim based on a prescription drug.Id. at *5 (quotation marks and citations omitted).  And as to reliance, plaintiff failed to plead anything beyond “generalized allegations that his (unidentified) physician viewed Avandia marketing materials.”  Id. at *6.            Plaintiff attempted to fit into the “almost impossible” category of viable prescription drug UTPCPL claims by alleging that defendant marketed Avandia directly to consumers.  Id. at *5.  Fortunately, like almost every court to consider the issue, this court found that DTC advertising doesn’t alter the role of the physician in prescribing medications to his patients:Media dissemination of information concerning the existence of these drugs does not enhance the public's ability to acquire them, as the skill and knowledge of the physician still must be brought to bear in a determination of whether the pharmaceutical is appropriate for the patient.   Because Plaintiff could not obtain Avandia without a physician's prescription, and the allegations with regard to the prescribing physician's exposure to, and justified reliance on, misleading information from Defendant are insufficient to state a cause of action, the learned intermediary doctrine bars Plaintiffs claim.Id. at *6.  In other words, even if plaintiff saw an ad for Avandia and asked his physician about it – it was still up to the physician to use his medical training and knowledge of his patient to decide whether to prescribe it.  His role as the learned intermediary is unchanged.  Furthermore, that role remains essential.  Plaintiff still could not obtain the drug without a prescription.  So, we come full circle.  The very reason for adopting the learned intermediary doctrine is a recognition of the patient-physician relationship, a relationship that it not altered by marketing to the general public.              With this decision shutting down yet another attempt by plaintiffs to sidestep the learned intermediary doctrine, it just became even more difficult to bring a consumer protection claim for a drug or medical device in Pennsylvania.  We won’t go so far as to say impossible, but it’s getting close.

New guns effectively banned in California

California has effectively banned the sale of all new guns after Attorney General Kamala Harris officiallycertified a law that will require all new semiautomatic handguns to use technology that stamps identifying information on bullet casings. Since gun manufacturers are not likely to spend money retrofitting their entire production lines, California has effectively banned the sale of all new guns.The law, which was initially signed back in 2007 by then governor Gov. Arnold Schwarzenegger, was delayed because of patents on the technology. On Friday, the Attorney General of California certified the law, becoming the first state in the country to require new guns use this stamping technology.The “microstamping” act requires every new handgun produced or brought into the state of California to have a special firing pin that will stamp a serial number onto the primer of a round.In reality, this technology will do nothing to prevent crime and will never be implemented, making the sale of all new guns into California illegal. In minutes a criminal could easily bypass this technology by filing the firing pin which would completely remove the stamp, rendering the technology completely useless. Despite this, California is pressing on with the new law.Attorney General Harris was quoted saying “This very important technology will help us as law enforcement in identifying and locating people who improperly and illegally use and discharge firearms.”That’s all nice and well, but who in their right mind believes a criminal is going to buy one of these self identifying weapons? What about the millions of illegal guns streaming over the Mexican border into California?In my opinion, this is just another example of punishing law abiding gun owners and yet again infringing on our Second Amendment right to defend ourselves. Since the law does nothing to stop illegal guns, nothing to go after the criminal gangs who are selling them, and doesn’t prevent criminals from bypassing the technology, there is little doubt what this laws really about – one more step towards banning all guns.
